Same-Sex Adoptions in Indiana

As a same-sex couple, you may be under scrutiny for your decision to adopt a child. Yet, study after study has shown that children raised by same-sex couples are typically as well-adjusted as children raised by heterosexual couples. The child you want to adopt needs a loving and financially secure home — you can provide it to him or her.

Throughout the United States, same-sex adoption laws continue to change, affected by multiple lawsuits. In Indiana, there is currently no ban on same-sex adoption and LGBT individuals may adopt children. Second-Parent Adoptions by Same-Sex Couples

If your gay or lesbian partner has a child that you would like to adopt, we can help you through the second-parent adoption process. Treated like a stepparent adoption, a second-parent adoption is only possible if the other biological parent is willing to relinquish his or her parental rights or the court grants a termination of parental rights.

LGBT couples also experience other challenges — since Indiana does not have a state law specifically permitting second-parent adoptions by a same-sex partner, a court may rule the adoption is not in the child’s best interests. Therefore, we strongly suggest that you hire an Indiana adoption lawyer familiar in this area of law.
