An Introduction to Adoption

Thank you for reaching out to us about adoption. The four attorneys here at Kirsh & Kirsh have 100+ years of combined experience practicing adoption law. We know you have many questions and are here to walk you through every step toward a successful adoption.

For interstate adoptions our services include compliance with the Interstate Compact on the Placement of Children (ICPC), a law which regulates an adoption of a child from one state to another. Each state has an ICPC office. If you live outside of Indiana, Kentucky, Mississippi, Tennessee, Michigan or Illinois and would like to work with us, you will need to consult an adoption attorney in your state to confirm that none of the following will prevent your adoption from receiving approval from your state’s ICPC office:

  1. Payment of the Kirsh & Kirsh, P.C., Adoption Services Fees of $27,500, which are in addition to attorney fees (but included in the total cost of adopting in the link below);
  2. Payment of Birth Mother Living Expenses allowed under Indiana law of $4,000 in total during the pregnancy (included in the total cost of adopting in the link below); and/or
  3. Any other aspect of working with our firm or provision of your state’s laws or ICPC regulations.

You can find an adoption attorney in your state at https://adoptionart.org/find-an-attorney/attorney-directory.

Step one: Introduction

Thank you for contacting us. Our law firm was established in 1981, and we have over 100 years of combined experience practicing adoption law.  Since then, we have helped prospective adoptive parents - individuals and couples - realize their dreams of parenthood through successful adoptions in Indiana and nationwide.

While we cannot guarantee your journey will be without bumps or even detours in the road, we can promise that we will be there to help you along the way. Our entire staff spends every working hour assisting people with adoptions.

Step two: Review our estimated list of expenses

This document should address something that is, no doubt, one of your biggest questions as you begin this process.

Step three: Learn more about Adoption Tax Credits

For most families, the Federal Government assists with $16,810 of adoption expenses in the form of a tax credit for the year your adoption is finalized. You will need to speak with your tax accountant to understand the details of the program; however, in general terms, families earning less than $252,150 a year (modified adjusted gross income) in 2025 will get a tax credit equal to their adoption expenses up to $16,810. The credit is reduced for families earning more than $252,150, but less than $292,150. Families earning more than $292,150 are not eligible to receive the credit. Another requirement of the credit is that the family has paid net Federal income taxes equal to, or greater than, the amount of the refund being requested, but any excess credit may be carried forward for up to five years. Your home state might also give a modest tax credit for residents who qualify for the federal tax credit.

Step five: Watch our adoption video

Our video is a very effective way to answer many of the most commonly asked questions about adoption. The video also provides a basic understanding of how we may help you become successful in adopting through our adoption law practice. The video addresses, in some detail, adopting through our office, including the costs, the procedures, the risks, and how to find a baby to adopt.

If you choose to work with us, it is mandatory that you watch the video, even if you have previously adopted elsewhere.

Our goal of requiring potential clients to watch this video is to provide you as much information as possible, so that you can make a well-informed decision about what could possibly be one of the most important decisions of your life.
