One such option is “Pre-birth Notice.” Simply stated, if an adoption attorney or adoption agency can arrange for notice of the adoption to be placed in the birth father’s hands prior to the birth of the baby and the father does not respond to the notice within 30 days of his receipt of it, the father’s consent to the adoption and further notice of the adoption are not needed. Very importantly, this can take place BEFORE the baby’s birth, does NOT require him to sign ANYTHING, and does not require the birth mother to put up her baby for adoption, or, more correctly, make an adoption plan if he does not respond. The “Pre-birth Notice” Statute has proven to be a useful tool in dealing with uncooperative alleged fathers. By the way, the statute does NOT require knowing for sure that the man to whom the notice is given really is the father. Therefore, if more than one man could be the father of the baby, the notice can be given to each of the possible fathers.
