WHAT IS THE STATUS OF INDIANA’S 2022 ABORTION LAW IN LIGHT OF THE RULING BY THE INDIANA SUPREME COURT IN MEMBERS OF THE MED. LICENSING BD. OF IND. V. PLANNED PARENTHOOD OF GREAT NORTHWEST, DECIDED ON JUNE 30, 2023?

WHAT IS THE STATUS OF INDIANA’S 2022 ABORTION LAW IN LIGHT OF THE RULING BY THE INDIANA SUPREME COURT IN MEMBERS OF THE MED. LICENSING BD. OF IND. V. PLANNED PARENTHOOD OF GREAT NORTHWEST, DECIDED ON JUNE 30, 2023?

The Indiana Supreme Court made three very significant rulings in this case. Firstly, the court held that the Indiana Constitution does not include a constitutional right of a woman to have an abortion. Secondly, the court held that the Indiana General Assembly has the power to limit abortions so long as the law allows a woman to have an abortion to protect her life or health. Thirdly, the state has a legitimate interest in protecting prenatal life. The court did not preclude other challenges to the 2022 abortion law, but held that the statute, as a whole, is not unconstitutional. 

Another case making its way through the Indiana courts includes a claim that the 2022 abortion law violates a woman’s freedom of religion. In other words, if a woman has a good faith belief that her religion allows abortion, the plaintiffs in that case claim that Indiana’s abortion law violates her right to have an abortion. The outcome of that case will not be known for a while; but given the recognition by the Indiana Supreme Court that the Indiana legislature has the power to protect unborn children, it will be interesting to see how the court will balance a woman’s religious freedom (if it agrees that such freedoms permit abortions) with the state’s interest in protecting an unborn child. 

Regardless of one’s feelings about abortion, a woman with an unplanned pregnancy or untimely pregnancy should, at least, explore adoption as an alternative to parenting or aborting the child.
